2. Gerneral Terms and Conditions
2.1. The General Terms and Conditions apply to all orders placed by the Customer (“the Customer” or “you”) when the Customer orders Svadia products via svadia.se. For orders placed via www.svadia.se, we only enter into agreements in Swedish. By placing an order for Svadia products, you enter into an agreement with Svadia.
2.2. By placing an order, you are also confirming that you are
- 18 years of age or older and not under guardianship; and
- a resident in Sweden.
2.3. Svadia reserves the right to change the terms and conditions without notifying the customer in advance of the changes in question. The General Terms and Conditions that are published on www.svadia.se at the time you place your order will apply to that specific order, i. e. both for the purchase and possible return process, even if the General Terms and Conditions have changed after you have placed your order.
3. Ordering and closing agreements regarding products
3.1. By clicking on "Confirm" in the last order step, a binding order will appear and you hereby undertake to purchase the Products that are in your shopping cart. Once you have confirmed your order, we will send an order confirmation of your order via email. A binding agreement is considered entered into when you receive the order confirmation. Please note that goods ordered against advance payment are reserved on your behalf as soon as we have received full payment of the purchase and any delivery costs. We therefore ask you to pay in full immediately after you have received your order confirmation, and no later than within 7 days. You agree that the seller may transfer its claim for payment to third parties.
4. Prices and Delivery Costs
4.1. The prices shown at the time of your order apply to your purchase. Prices are stated in Swedish kronor (SEK) and include VAT. Svadia, or relevant Svadia partner in the purchase of Partner Products, has ownership of the products until full payment has been made.
4.2. When ordering for at least 599 Swedish kronor (SEK), delivery to the postal agent is included free of charge. When ordering under 599 SEK, delivery to the postal agent costs 69 SEK. The delivery cost will be clearly presented in the order process where the full amount charged (including any delivery costs) is given under "total amount" before your order is confirmed and becomes binding.
5.1. Svadia offers payment by Klarna
5.2. By accepting these terms and conditions, you are deemed to have given your consent to any invoices and credit invoices being sent exclusively to you in electronic form.
6.1. We are only obliged to deliver goods that are available in our warehouse, including such goods that must be received according to orders from our suppliers. Svadia also reserves itself for any final sale of the products until they have left Svadia's warehouse. If a product is not in stock, we will contact you and refund any amount paid without undue delay. Furthermore, we do not undertake to procure ordered products from any other source. This also applies to orders for generic goods (which means goods where only the current product type and properties are stated).
6.2. Products purchased on www.svadia.se are only delivered to addresses within Sweden. When delivery times are stated in working days, working days are to be understood as all days from Monday to Friday, excluding Midsummer, Christmas Eve, New Year's Eve and national holidays in Sweden(i.e. so-called red days).
6.3. We deliver your products to the delivery address (nearest postal agent) you specified in your order. When you place your order, you will see the estimated delivery time. The delivery time will be updated when we send the order confirmation to your e-mail address.
6.4. If you choose regular delivery of your order, our goal is to deliver your order within 2 to 5 working days after you place the order.
7. Offers and discount codes
7.1. Offers and discount codes cannot be purchased but are a part of Svadia's marketing and are only valid for a limited time.
7.2. Offers and discount codes can only be used once (1) per order and only within the validity of period specified. Some brands or goods may be excluded, which means that the offers do not apply nor can discount codes be used for the purchase of these brands or goods. Discount codes cannot be used to purchase gift cards. Please note that your order may need to meet a minimum order value to take advantage of certain offers or discount codes.
7.3. The total order value must correspond to or exceed the value of the offers and discount codes. If the total order value exceeds the value of a given offer, you can make payment of the excess value through one of the payment options available, please see section 5.1. It is not possible to redeem discount codes for cash nor is there any interest on the discount codes. If you exercise your right of return with respect to all or part of your order, we will refund the discounted amount you have paid for the returned products.
7.4. You can only use discount codes before the ordering process is completed. This means that it is not possible to apply discount codes with retroactive effect. Discount codes are personal and may not be transferred to third parties. Unless otherwise stated, discount codes cannot be combined with other offers.
7.5. If you choose to exercise your right to return one or more products from an order where you have used a discount code or taken advantage of a special offer, and the total order value no longer fulfils the terms of the offer or discount code, we reserve the right to charge you the regular price for the products. This depending on the terms of the current discount code or offer.
8. Gift Cards
8.1. Gift cards constitute value credits offered for sale and can only be used to buy products. The credit on the gift card is used before you confirm your order. If the total order value exceeds the value of the gift card, you can make payment of the excess value through one of the payment options offered, please see section 5.1.
8.2. Gift cards cannot be used to buy additional gift cards nor be redeemed for cash. By logging in to your user account at www.svadia.se, you can use gift cards, add them to your user account and see the balance of any credits. There is no interest on the gift cards.
9. Right of withdrawal
9.1. When you shop at www.svadia.se, you have a legal right to cancel your purchase.
9.2. If you want to return a product, you can either use the return slip that accompanies your order or print a return slip via your user account at www.svadia.se or contact customer service. If you have questions about the return process, do not have access to a printer, have difficulty downloading the return slip or need a new one, you are welcome to contact our customer service.
9.3. You are entitled to exercise your right of withdrawal against Svadia and return your order without giving any reason within 14 days. The withdrawal period of 14 days runs from the day when you or a third party who acted on your behalf, but not the transport company, received the last product in the order.
9.4. If you wish to exercise the right of withdrawal, you must send a clear and explicit written notice stating this to us using our email firstname.lastname@example.org.
9.5. You can also exercise your right of withdrawal by using the standard form that can be downloaded from the Swedish Consumer Agency's website at www.konsumentverket.se and send it to email@example.com.
9.6. If you exercise your right of withdrawal, you are obliged to return without undue delay, and no later than 14 days from the day you notified us of your desire to exercise the right of withdrawal, all products for which you wish to exercise your right of withdrawal.
9.7. If you exercise your right of withdrawal vis-à-vis Svadia, we will refund all payments received from you, including delivery costs (except for increased delivery costs due to your choice of a delivery option that does not correspond to the lowest priced standard options that we offer for the delivery in question). The refund will be made as soon as possible and no later than 14 days from the day we received notification of your desire to exercise your right of withdrawal regarding the order. We will use the same payment method for the refund that you have used for the current order, if Svadia and you do not explicitly agree on anything else. The administrative cost the refund entails for Svadia will not incur any additional costs for you.
9.8. The foregoing means that you meet the requirements in section 9.7 if you return the products before the expiry of the 14-day deadline. We will bear the cost of the return, provided you use the enclosed return slip. If you do not use the return slip, you are obliged to pay the return costs yourself. A condition for full refund is that the products are sent back in the same condition as they were when you received the delivery. If a decrease in value is found to have occurred due to your handling of the products, you are obliged to bear the costs of this. For products that have been sealed for health or hygiene reasons, this means that the return of the products presupposes that the seal has not been broken. If the products are not returned in the condition described in this section 9.8, we have the right to refuse your return or reduce the amount we pay back to you. I hereby announce that I withdraw from my purchase agreement regarding the following
10.1. You always have the right to report defective products within 14 days of receiving the products. Complaints made within 7 days from the time of receiving the products.
10.2. If the returned products are found to be defective, Svadia will make a full refund corresponding to the purchase price for the products, as well as the delivery costs hereof. For a product to be deemed defective, the defect must have occurred before the time of sale. If you complain about a defective product within 7 days from the time of sale, the defect is considered to have occurred before the time of sale, unless this is disproved by Svadia. However, if the complaint occurs more than 7 days after the time of sale, you are obliged to submit proof showing that the error occurred before the time of sale. 11.1. Refunds are made automatically using the same payment method used to pay for your order. If the payment was made by invoice or by advance payment, the refund will be made to the account from which the payment was made. To make a transfer, we may require your account information.
12. Intellectual property rights
12.1. All intellectual property rights belonging to Svadia, its group companies and/or licensors, including but not limited to trademarks and works protected by copyright reproduced on svadia.se, belong to Svadia, its group companies and/or its licensors who retain all rights thereto. This means that all use of www.svadia.se or its content that constitutes a use requires the prior written permission of Svadia. The foregoing shall not apply to use that falls within a customer's measures regarding orders, administration and use of services related to the customer's purchase of Svadia products. For the sake of clarity, this means that all copying or storage of content from www.svadia.se, in its entirety or parts thereof, for purposes other than for a customer's private, non-commercial uses, requires prior written permission from Svadia. This limitation includes, but is not limited to, trademarks, company names, product names, images, photos, graphic design elements, and information about Svadia products.
13.1. These General Terms and Conditions and your agreement with Svadia do not absolve Svadia from or limit Svadia's liability under applicable consumer protection legislation.
13.2. If any provision of these Terms and Conditions, or any part thereof, are found to be invalid, this shall not affect the validity or interpretation of other provisions of herein, unless Svadia or the customer's obligations, in the exclusion of such provisions, would be considered unreasonably burdensome .
13.3. Use of the offers available on www.svadia.se is possible for people who are at least 18 years old.
13.4. Each customer may only maintain one Svadia customer account at a time. We reserve the right to delete multiple registrations.
14. Alternative dispute procedure
14.1 As a consumer, you have the right, if you have a complaint about a purchase which could not be resolved through direct contact with Svadia, to turn to an alternative dispute resolution body to make amends. Applying to an alternative dispute resolution body is generally cheaper, less formal and faster than going to court. You can only use this option if you are resident in the EU and the other party is established in the EU. You can either use the online complaint platform available on the European Commission's website, www.ec.europa.eu/odr, or contact the General Complaints Board directly, via www.arn.se. The General Complaints Board is an approved board for alternative dispute resolution and is subject to Directive 2013/11/EU on alternative dispute resolution in consumer disputes.
15. Applicable law and dispute resolution
15.1. These General Terms and Conditions and the agreement between you and Svadia, and where applicable relevant Svadia partner, shall be subject to and interpreted in accordance with Swedish law. Disputes arising from these General Terms and Conditions shall be settled by a general court in Sweden.
